Where the Law Says So

The Education Freedom Tax Credit was created by Section 70411 of the One Big Beautiful Bill Act (Public Law 119-21), signed into law in July 2025. The statute defines qualified education expenses by reference to Section 530(b) of the Internal Revenue Code — the same definition Congress uses for Coverdell Education Savings Accounts. Tutoring is named explicitly within that definition.

The provision in P.L. 119-21 that establishes the federal credit, sets the $1,700 cap, and defines eligibility for donors, students, and Scholarship Granting Organizations.

Why Fund Tutoring? The First-Grade Window

First grade is the decisive window for closing the literacy gap — and high-dosage tutoring is the most evidence-backed intervention.

If a student is reading on grade level at the end of 1st grade…

85%

of those students remain on grade level through 2nd grade.

If a student is below grade level at end of 1st grade? Only…

12%

of those students catch up by the end of 2nd grade.

After high-dosage literacy tutoring in first grade, students reading at grade level increased 8x — from 6% to 48%.

Frequently Asked Questions

Answers to the most common questions about funding tutoring through the Education Freedom Tax Credit.

Is tutoring a qualified education expense under the Education Freedom Tax Credit?

Yes. The statute establishing the Education Freedom Tax Credit lists tutoring among qualified education expenses, defined with reference to Section 530(b) of the Internal Revenue Code.

Can I direct my entire eligible donation to tutoring?

Yes. Donors choose which approved Scholarship Granting Organization receives the contribution. An SGO whose scholarships fund tutoring will direct the funds accordingly.

What is an approved tutoring SGO?

An approved Scholarship Granting Organization is a 501(c)(3) non-profit that appears on the state’s certified list submitted annually to the U.S. Treasury.

What kind of tutoring do EducationSuperHighway scholarships fund?

EducationSuperHighway scholarships fund a full year of daily one-on-one literacy tutoring, 15 minutes per session, using methods grounded in the Science of Reading. Tutors focus on closing decoding gaps to help first-graders become confident and fluent readers before second grade.

Do I still get up to a $1,700 dollar-for-dollar credit if my donation funds tutoring?

Yes. The tax treatment of the donation is identical regardless of the qualified education expense the scholarship ultimately covers. A cash donation up to $1,700 to an approved SGO produces a dollar-for-dollar federal tax credit.

What happens if my state hasn't opted in?

You can still donate to an approved SGO operating in any participating state and claim the federal credit. Your state of residence does not need to approve SGOs for you to claim the federal credit. EducationSuperHighway is pursuing approval in multiple states so donors nationwide can contribute.
